**One Thing Is Becoming Even More Clear After Today’s DHS Hearing on Capitol Hill**

Washington, D.C. – February 17, 2026

After more than five hours of tense, often combative testimony before the House Homeland Security Committee this afternoon, one conclusion now seems inescapable: the United States is no longer dealing with a traditional immigration challenge. What the country faces is a full-spectrum border and interior-enforcement crisis that has outgrown the existing legal, logistical, and political frameworks designed to manage it.

Homeland Security Secretary Kristi Noem, testifying under subpoena after weeks of stonewalling Democratic requests, faced a barrage of questions from both sides of the aisle. Republicans demanded to know why “sanctuary city” policies continue to obstruct ICE detainers in more than 600 jurisdictions. Democrats pressed her on reports of overcrowded family detention centers, the use of military aircraft for deportation flights carrying children, and the sudden spike in workplace raids that have left entire industries short-staffed overnight.

But the most revealing — and least partisan — moments came when career DHS officials, speaking under oath, acknowledged three interlocking realities that no administration has yet solved:

1. **The asylum system is functionally broken.** The average credible-fear interview now takes 214 days (up from 89 days in 2020). The immigration-court backlog stands at 3.7 million cases. The credible-fear grant rate has fallen to 38% — meaning six out of ten people who claim fear of persecution are later found not to have a credible case — yet almost all are released into the interior with a future court date years away because detention space simply does not exist.

2. **Interior enforcement capacity has collapsed.** ICE’s non-detained docket now exceeds 8.1 million individuals. The agency has only 6,200 deportation officers — roughly the same number it had in 2010 — despite a non-detained population that has quadrupled. The result: fewer than 1 in 12 removable non-citizens is ever removed. Secretary Noem admitted under questioning that “current resources allow us to prioritize only the most egregious criminal aliens,” leaving hundreds of thousands of others effectively unmonitored.

3. **Border Patrol is no longer primarily a border agency.** Agents testified that 62% of their shift time is now spent on post-arrest processing, transportation, medical care, and paperwork rather than actual patrol. The average agent processes 11–14 individuals per shift — most of whom are released with a Notice to Appear. The border is not being “secured”; it is being administratively managed at a loss.

The hearing’s most electric exchange came when Rep. Nancy Mace (R-SC) asked Secretary Noem point-blank: “If you had unlimited funding and zero political constraints, how many people could ICE realistically remove in a 12-month period?” Noem’s answer — “At current staffing and detention capacity… perhaps 280,000 to 320,000” — landed like a thunderclap. That figure is lower than the number of encounters recorded in December 2025 alone.

Democrats countered with images of children in crowded holding cells and testimony from a former CBP medic who said she had treated “more unaccompanied minors with hypothermia in the last six months than in my previous 12 years combined.” Republicans responded with body-cam footage of agents being assaulted by smuggling groups and statistics showing a 41% increase in assaults on officers since 2024.

Yet the most sobering moment came from a non-partisan witness: former CBP Commissioner Mark Morgan, who served under both Trump and Biden. “We are no longer catching people at the border,” Morgan testified. “We are processing them at the border and then releasing them into the interior. The deterrent effect of apprehension has been eliminated. Until Congress changes the law or the executive branch finds the political will to detain and remove at scale, the numbers will continue to rise.”

The hearing ended without resolution — no new legislation was proposed, no funding increase was promised, no policy shift was announced. But the cumulative picture that emerged was unmistakable: the system is not strained; it is broken beyond incremental repair.

Outside the Rayburn House Office Building, protesters from both sides clashed briefly before being separated by Capitol Police. Inside, lawmakers from both parties privately admitted the same thing: no president — Republican or Democrat — has yet demonstrated the political courage to demand the scale of detention, deportation, and legal reform that would be required to regain control.

One thing is becoming even more clear after today’s DHS hearing on Capitol Hill: the border crisis is no longer about numbers. It is about whether the United States still has the institutional will — and the political permission — to enforce its own immigration laws at the scale required in the 21st century.

So far, the answer appears to be no.

And until that changes, the line at the southern border will keep growing — and the quiet crisis inside America’s cities and courtrooms will keep deepening.
