WASHINGTON — In a confrontation that quickly moved from policy dispute to constitutional alarm, Representative Delia Ramirez of Illinois accused Homeland Security Secretary Kristi Noem of lying to Congress, ignoring federal court orders, and presiding over unlawful detention practices that, she said, have ensnared American citizens and thousands of people with no criminal records.

The exchange unfolded during a House oversight hearing and was striking less for its volume than for its specificity. Ramirez did not rely on broad denunciations. She cited arrest figures, court rulings and documented reporting to argue that the administration’s public claims about immigration enforcement do not match its actions.

“Secretary Noem, you lie and you lie to the American people,” Ramirez said, directly challenging repeated assertions from the Department of Homeland Security that enforcement operations focus only on “the worst of the worst.”

At the center of Ramirez’s case was evidence that U.S. citizens have been detained by immigration agents — a charge that contradicts the administration’s narrative. She pointed to documented cases of citizens being held for days, sometimes subjected to physical force, and later released without charges. She also cited data showing that tens of thousands of people arrested by Immigration and Customs Enforcement had no criminal records, undermining claims that enforcement actions are narrowly targeted.

But the hearing’s most consequential moment came when the discussion turned to court orders. Ramirez pressed Noem about deportation flights that continued even after a federal judge ordered them halted, including flights to a mega-prison in El Salvador. When asked who authorized the decision to proceed, Noem did not deny responsibility. She said that decisions about deportations and flight operations fall under her authority at the Department of Homeland Security.

For Ramirez, that response crossed a constitutional line.

When executive officials openly assert the right to disregard judicial orders, she argued, the issue is no longer immigration policy but the separation of powers itself. Courts, she emphasized, are not advisory bodies. They are a co-equal branch of government whose rulings are binding.

“That’s not a policy disagreement,” Ramirez said. “That’s defiance of the courts.”

She further alleged that DHS agents used chemical agents during enforcement actions in Chicago despite a district court order forbidding their use, and that communities across the country have been subjected to warrantless arrests, surveillance and aggressive crowd-control tactics. Ramirez described neighborhoods “terrorized” by enforcement operations that, she said, violated due process and left families traumatized.

Throughout the exchange, Noem defended the administration’s approach as necessary to protect public safety and criticized what she called “radical judges” who attempt to interfere with executive authority. Supporters of the administration argue that DHS is operating within its mandate to enforce immigration law and that courts have overstepped their role.

Ramirez rejected that framing. She said she had repeatedly sought meetings with DHS officials and with Noem herself to address concerns about enforcement practices, only to be rebuffed. During the hearing, she entered into the record correspondence requesting oversight meetings, arguing that the department’s refusal to engage reflects a broader contempt for congressional oversight.

The confrontation ended with an unmistakable ultimatum. Ramirez told Noem that her options were limited: resign, be fired, or face impeachment. She said she had already called for Noem’s resignation and had urged the House Judiciary Committee to open an investigation into what she described as impeachable offenses.

“When officials lie to Congress, misuse funds appropriated by Congress, and ignore court orders, impeachment is not extreme,” Ramirez said. “It is the mechanism the Constitution provides.”

The stakes of the exchange extend beyond the individuals involved. At issue is whether the executive branch can selectively comply with judicial rulings while insulating itself from legislative oversight. Legal scholars have long warned that such a dynamic erodes the rule of law, replacing it with discretionary power.

Ramirez framed the debate in human terms as well as legal ones. Behind every statistic, she said, are people detained without cause, families separated without due process, and communities left fearful of authorities meant to serve them. The cost of constitutional violations, in her telling, is measured not only in precedent but in lives disrupted.

Oversight hearings often generate viral moments, but this exchange carried a deeper significance. It crystallized a question that has increasingly defined American governance: What happens when accountability mechanisms are treated as obstacles rather than obligations?

If Congress cannot compel truthful testimony, if court orders can be brushed aside, and if executive power operates without consequence, Ramirez warned, then constitutional checks and balances become ceremonial.

Whether her call for resignation or impeachment gains traction remains uncertain. But the warning she issued was clear. The rule of law, she argued, does not erode all at once. It weakens when violations go unanswered — and when those entrusted with enforcing the law decide which laws apply to them.
